Terms and Conditions of ArcanaStream

Welcome to ArcanaStream! These Terms and Conditions govern your use of our website and services, accessible via arcanastream.io and arcanastream.com. By accessing or using our platform, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account, accessing, or using ArcanaStream's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

2. Description of Services

ArcanaStream provides a platform that enables content creators to:

• Stream pre-recorded video content 24/7 to multiple platforms
• Schedule and manage streaming content
• Access high-availability streaming infrastructure
• Integrate with platforms including Twitch, YouTube, Twitter, Instagram, and others
• Monetize content through subscriptions, donations, and ad revenue

3. Account Registration

To access certain features of our services, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. User Conduct and Content

You are solely responsible for all content that you upload, import, store, schedule, transmit, re-stream, or otherwise make available through ArcanaStream ("User Content"). Before using any User Content with our services, you represent and warrant that you either own that content or have obtained all rights, licenses, permissions, and consents necessary to use it through ArcanaStream and to distribute it on every selected third-party platform.

You agree not to use ArcanaStream to:

• Upload, stream, or distribute content that infringes on intellectual property rights
• Use music, video, images, trademarks, performances, or any other protected material without all required rights and clearances
• Upload or broadcast personal data, images, or recordings of another person without a valid legal basis and any required consent
• Share content that is illegal, harmful, threatening, abusive, or discriminatory
• Distribute malware, viruses, or any harmful code
• Engage in spam, phishing, or fraudulent activities
• Violate the terms of service of third-party platforms (Twitch, YouTube, etc.)
• Attempt to gain unauthorized access to our systems or other users' accounts

5. Subscriptions and Payments

ArcanaStream offers various subscription plans with different features and pricing. By subscribing:

• You authorize us to charge your payment method for all fees associated with your subscription
• Subscriptions automatically renew unless cancelled before the renewal date
• We may change subscription prices with 30 days advance notice
• All payments are processed securely through Stripe
• Prices are in USD unless otherwise specified

6. Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• No refunds will be provided for partial months or unused time

7. Intellectual Property

All content, features, and functionality of ArcanaStream (including but not limited to software, text, graphics, logos, and trademarks) are owned by ArcanaStream or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you upload to ArcanaStream. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content solely for the purpose of providing our services.

This license includes the technical rights necessary to host, copy, encode, transcode, transmit, display, and deliver User Content to the destinations you select. You remain responsible for obtaining and maintaining every right required for those uses. ArcanaStream may restrict access to, remove, or disable User Content when reasonably necessary to respond to a rights complaint, comply with law, protect third-party rights, or enforce these Terms.

8. Third-Party Platforms

ArcanaStream integrates with third-party platforms (Twitch, YouTube, etc.). You acknowledge that:

• You must comply with each platform's terms of service
• We are not responsible for any actions taken by third-party platforms
• You are solely responsible for checking that your User Content and your use of it comply with each destination platform's copyright, music, advertising, monetization, and community rules
• To the maximum extent permitted by law, ArcanaStream is not liable for copyright claims, content takedowns, strikes, demonetization, stream interruptions, account suspensions, or account bans imposed by a third-party platform because of your User Content or your breach of that platform's rules
• Platform integrations may be modified or discontinued without notice
• You are responsible for maintaining valid credentials for third-party platforms

9. Limitation of Liability

To the maximum extent permitted by law, ArcanaStream shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or technical failures
• Actions or content of third-party platforms
• Unauthorized access to your account or content

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intentional misconduct or gross negligence where applicable. You remain responsible, to the extent permitted by law, for claims and losses resulting from your User Content, your lack of the required rights or consents, or your violation of these Terms or a third-party platform's rules.

10. Service Availability

While we strive to maintain 99.9% uptime, we do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice
• Experience unexpected downtime due to technical issues
• Modify or discontinue features without liability

11. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms and Conditions
• Engage in fraudulent or illegal activities
• Fail to pay subscription fees
• Upload prohibited content

12. Changes to Terms

We may modify these Terms and Conditions at any time. We will notify users of significant changes via:

• Email notification
• Platform announcements
• Updated "Last Updated" date on this page

Continued use of our services after changes constitutes acceptance of the modified terms.

13. Governing Law
